View Full Version : Help With a Disclaimer..Can I get some?

I am in the process of starting to do cadd work on my own and I am creating my title block and logo. Does anyone have any ideas or sample disclaimers that I should have? What SHOULD be said in it to protect me?

That really depends on the type of work you plan on doing. Are you going to work for someone else? If so, what kind of work (arch, mech, elec, or house plans, or general cad work)? If you are going to be doing consulting cad work for say an arch, they will have their own title blocks that you will need to work with. And that is probably true of most consulting cad work.

this is true. if you're doing CAD work for them, then it's their liability - not yours. You're just drawing what they tell you to draw. Now, if you're taking credit for you drawings, as in - you are insuring your drawings are accurate and WILL work, then you'll need something. but, unless you're some type of engineer (and I assume you're not) then I wouldn't worry about it. :)

I am not an engineer or architect. I am a cadd operator. I work full time for a firm. I am starting to do house plans on my own. I wont be going to another office for work. I will be doing it from my house and on my own time. So I will need something to protect me that I can put on my drawings.

I will also be doing any other cadd work that may come my way...paper to cad coversions...renderings...3d...whatever :)

Well, if you are doing house plans, is it for a specific client? Or a contractor? In that case, then your best bet would to be to go to a lawyer and ask them to draft a statement for you. Make sure that it puts most (or all) of the liability on the contractor if you are not confident about the struct design of your drawings.

A simple copyright should suffice. You should also have something in your contract about not having errors and emissions insurance. You will have to check on your local state law about that.

What do you guys think of this? I took this from a former employers title block (I hope that is not a crime)...

Bit of double dipping with your note.......you can't say FOR INFORMATIONAL PURPOSES ONLY and then turn around and say BEFORE ACTUAL CONSTRUCTION BEGINS. The information you provide is either for information, or for construction.....

Do you really think that just because you have some fancy worded disclamer that it is going to cover you if there is some problem....I can imagine some lawyer saying for the plantiff..." oh this cad guy has a disclamer on his drawing,well that lets him off the hook,I won't write his name on the summons"...If there is a problem...see you in court...these friggin lawyers have messed up everything!!!

When it comes to suing people, lawyers will go after anyone and everyone no matter what. Have an attorney advise you on your disclaimer. It could be it isn't worth the paper it's plotted on. Best if you know that beforehand. Otherwise, good luck on your endeavors. Keep us updated on your success.

This will 100% save your ass. be sure and get a construction lawyer though. Very thorough people.

Well, Cali is the worst state/province on earth for getting sued.

Have you got that one right!!!...I am a contractor here and I was named in a suit just because I had the same name as the real contractor that did the shoddy work..this case was 300 miles away,in a city and county that I have never done any work in...I had to pay 300 just to hire a lawyer to tell the sueing lawyer that I was in no way involved...What a racket these guys have set them selves up with...Oh and by the way...there is about 10 contractors here with similar names like mine...all of them were named!!!

LMAO, the size of our town has gone from 250,000 to 650,000 in the last 5 years because of all the californians moving up here. You would fit right in :) I have lived in 12 states and oregon is my favorite next to alaska. Very cheap to live here compared to cali. Great weather. One of the most beautiful places in the US in my opinion. Sometimes its hard to find a job though, because Oregon has the lowest unemployment rate in north america. Combined with being one of the most educated states, that can make it tough. Lots of degrees to compete with. Good pay though.....oh yea and no sales tax.
