my 2009 civil 3d can only save as 2007

Our clients keep asking us to send in 2009 format, but from what i hear, autocad 2009 will only save as 2007... is the only option we have...

The last four file formats are 2000, 2004, 2007 and 2010. File formats do not change every year at least as far as plain AutoCAD goes. I don't know what they do for Civil.
