proper way to cutomise menus with CUI

i am looking for the right way to customize contextual menus .

for instance the default contextual menu ( right clicking with no object selected )

 

creating a new contextual menu called "default" from my CUi, seems to do nothing .

the only way i found was to customize (add commands to) the acad default contextual menu .

that would mean my custom "default" contextual menu is only a backup , in case i want to save the commands i added .
